Buying ventolin inhaler tablets and prescribing them to his patients at medical practice, according to court documents. The tablets were then seized by narcotics agents from his business office.
That August, Filippov received a DEA alert about an individual being investigated for possession and trafficking of narcotics. It's unclear if this is the same man, or if it was a different individual.
Filippov was arrested on Oct. 30.
During his interviews with court employees, Filippov admitted that over a period of three years, up to 1,200 Ventolin inhalers would be dispensed from his pharmaceutical practice, according to the DEA.
He said didn't recall making a prescription for each patient, and didn't require patients to sign a dispensing authorization form if they did not have health insurance. He also said that, if any patient requested a Ventolin inhaler, he would fill that prescription for them "because I'm using the pills to treat my illnesses," court documents state.
Filippov described his prescription pad as a "slap-dash piece of paper [that] I use to record orders for the medication from lab to pharmacy." And in his testimony, he confirmed that, with three other doctors in his practice, he prescribed Ventolin in the amount of 12 to 20 inhalers per day.
"The majority of the prescriptions, I've written for office," Filippov testified. "I've written at least 100, 200 prescriptions in the last few years."
Filippov's attorneys called the practice of prescribing Ventolin as prescribed by his patients a mistake, but "minor" mistake when compared to the quantity of medication that was dispensed.
"He wrote 20 prescriptions out of the box – just like anything else. He didn't realize they got a little bit bigger," defense attorney Bill O'Connor told Judge Kelly in court on Friday.
O'Connor told the judge that Filippov would "exhale" – spit out the pills if there was a "dime bag."
Filippov took two lie-detector tests while being held in jail. The first was conducted by DEA narcotics agent Matthew J. Schuster, who noted in his report that the defendant had a prior conviction for possession of oxycodone "on account substance abuse."
"I don't see any significant drugs in the body of Mr. Filippov," Schuster wrote when queried by Schuster. "There are indications of a minor substance abuse problem with Mr. Filippov."
The defendant's defense team also noted that Filippov had received his pharmacy license only recently.
But Assistant U.S. Attorney Robert C. Glynn disagreed.
"Mr. Filippov has been a pharmacy for over 20 years," Glynn said. "He's been doing this since he opened his office. He's been doing this for years one reason or another."
According to Glynn, the Filippov situation "comes to show the importance of pharmacist to whole operation. Without them, many of these operations would not be in business."
Prosecutors pointed to a DEA report that said Filippov prescribed a total of 1,200 Ventolin inhalers during the two-year time period. total of those prescriptions equals 1,200 inhalers per day.
